XXXI Session of the Tomsk Oblast State Duma

At the beginning of the Session, Boris Maltsev, Speaker of the Tomsk Oblast State Duma, underlined that the Oblast Duma is the only parliament in Russia and in Europe that have been working in August for 15 years, not leaving for summer recess.

In the second reading the deputies adopted the Oblast Law giving the local authorities powers in upbringing and educating physically disabled children in municipal pre-school educational institutions. Spending for students of municipal pre-school educational institutions was increased to make up, in 2010, a 2m rubles increase for 331 physically disabled children going to municipal pre-school educational institutions of Tomsk Oblast.

The Duma adopted amendments to the Oblast Law “On education” which stipulate uniform rules for payment of qualification bonus to teaching staff. Before the amendments, the bonus was determined as a percentage from the fixed salary. Now it is full-rate fixed. According to the Tomsk Oblast Administration calculations, after adoption of the amendments the bonus will by no means decrease, but rather grow. To that end, the Oblast budget will additionally allocate 18.6m rubles for 4 months of 2009 and 56m rubles for 2010.

Amendments to the Law “On education” allow equalizing in rights parents whose children go to public, municipal and private nurseries. If a child goes to a private nursery implementing the basic pre-school general education curriculum, parents have the right for partial compensation of the parental fee just like parents whose children go to municipal and public nurseries. The compensation rate will be calculated by the Tomsk Oblast educational authorities will annually determine the average parental fee for keeping a child in public and municipal pre-school educational institutions of Tomsk Oblast. Compensation for the first child will make up 20% of the average rate; for the second child 50%, for the third and further children 70%. That is, the compensation will be the same regardless of the type of nursery a child goes to (private or municipal).

Grigory Shamin, Head of the Law Committee, clarified: ‘For those parents whose children go to municipal and public nurseries nothing will change – they will continue receiving their compensation. Also, nothing will change for parents whose children go to private nurseries working under the municipal agreement – the compensation has been provided there as well. The changes concern only parents whose children go to private non-public nurseries which do not have a municipal agreement.

Amendments to the Oblast Law “On measures of social support in payment for housing and utility services for certain categories of citizens who work (worked) and live in the rural area and semi-urban settlements in Tomsk Oblast” were adopted. The amendments envisage provision, from January 1, 2010, of monetary benefits to people with a university degree working in rural areas.

Pilot implementation of the new law has been run in Kozhevnikovsky District where, from July 2009, such a benefit has been provided to 3,300 people. Sergey Ilyinykh, First Deputy Governor of Tomsk Oblast, says that the amount of the benefit to be paid is absolutely equal to the amount of previously provided benefits in kind. The payments will be either delivered at door together with pensions, or accrued in the accounts opened with credit institutions. In September the authorities will launch an extensive public outreach campaign; each beneficiary will be provided with an information booklet; some outreach meetings have already taken place.

Amounts to be paid under an agreement will de determined in cooperation with housing maintenance and utility enterprises under the agreements concluded with them; centers for social support will check correctness of the numbers. Those who received the benefits before January 1, 2010, will not have to submit any additional documents. The list of documents to be submitted is relevant only for the citizens who apply for the benefit for the first time.

Nikolay Kirillov, a deputy of the Oblast Duma, asked to list the eligible categories of citizens working in the rural areas. Sergey Ilyinykh annouced the categories: teaching staff, librarians, medical staff in the educational institutions, retired teachers who had worked in a teaching position in the rural area for at least 10 years, social workers employed in the sphere of social service, medical and pharmaceutical public health organizations, cultural workers: about 10,000 of people in total.

Rashid Aminov, one of the deputies, asked how much would be allocated from the budget for that purpose. Sergey Ilyinykh answered that the allocations would amount to 1.3bn rubles when all benefits in kind are converted into money from January 1, 2010. The benefits will be partially financed from the federal budget.

In two readings the deputies adopted amendments to the Law “On 2009 Oblast budget and planning period of 2010 and 2011”. In a speech addressed to his colleagues, Vladimir Ponomarenko, Chairman of the Budgetary and Financial Committee, confirmed that the Committee has approved all crisis management actions adopted by the Oblast Administration and included in the proposed version of the Law on the budget.

‘Notwithstanding certain problems involved in formulation of the revenue item of the budget, we have still managed to keep 10% of the budget for the investment and innovative activity,’ Boris Maltsev said.

After yet another amendment the budget revenues amount to 28,438m rubles; expenses 28,620m rubles; deficit 182m rubles. As of October 1, 2010, the internal debt of the region will be 7,841m rubles or 39.5 % of the total revenues, excluding non-repayable receipts.

Two basic Oblast Laws were passed in two readings – “On system of documents on strategic planning and accountability management of Tomsk Oblast” and “Interaction between the Tomsk Oblast authorities and Association “Council of Tomsk Oblast Municipal Entities”. The first Law establishes a regulatory framework for development and further functioning of the system of documents on strategic planning and accountability management of Tomsk Oblast. The second law determines powers of the Oblast authorities on interaction with the Council of Municipal Entities.

Amendments to the Oblast Anti-Corruption Law which oblige public officers to declare their family income details were adopted in the second reading. A norm regulating the procedure of declaring income and property by public officers and their family members (spouse and under-age children) was entered into the Oblast Law. The list of the public officers who are to declare the income of their family members annually, will be approved by the Governor.

Amendments were made to the Oblast Law “On leasing and gratuitous use of Tomsk Oblast public property”. The adopted amendments demarcate the powers of different authorities in the Oblast property management issues. Lease or gratuitous use agreements shall now be awarded based on the results of a tender. The amendments also expanded the related rights of the Tomsk Oblast State Duma.

The deputies adopted amendments to the Oblast Law “On the system of executive bodies of the Tomsk Oblast authorities and structure of the Tomsk Oblast Administration”. From January 1, 2010, the
Regional Energy Commission
will become part of the Public Contract and Pricing Policy Department of the Tomsk Oblast Administration which will be renamed into the Tariff Regulation and Public Contracts Department. Currently, there are two regional bodies involved in government control of prices for goods and services, and reorganization is required to pursue a uniform tariff policy. Besides, the reorganization will allow optimizing the management structure in this sphere. On the country-wide level it has already been done, all issues are handled by the Federal Tariff Service. Similar integration took place in 8 out of 12 regions of the Siberian Federal District.

In the first reading the deputies adopted amendments to the Law “On basic guaranties of children’s rights in Tomsk Oblast”. In accordance with the amendments, the list of places where children are prohibited to be without parents at night will be developed together with expert commissions. It is assumed that such places in the territory of a municipal entity will be determined by representative bodies of this municipal entity based on an expert commission’s opinion.

Within ‘A Governor’s Hour’ the deputies were informed on implementation of the measures on prevention of road accidents.
