The session was broadcast online. The agenda of the session and the bills submitted for consideration by the deputies were published on the Duma website beforehand.
Opening the session, Duma Speaker Oksana Kozlovskaya handed the deputy’s credentials over to Aleksander Frenovsky. He was accredited by the deputies at the 3rd session of the Duma.

DEPUTIES DELIVERED THEIR STATEMENTS
Oleg Gromov drew the deputies’ attention to the problem of the devastation of the Siberian forests by hunters with modern machinery. He suggested holding a public discussion of forest protection issues, and developing regulations on snowmobiles in hunting areas.
Oleg Shuteyev shared a piece of good news. On February 24, grammar school No. 55 in Kashtachny constituency No. 6 opened after major repairs. It is a small school which celebrates its 85th anniversary in a few years’ time. Oleg Shuteyev thanked the Governor of Tomsk Oblast, the Speaker of the Oblast Duma, and the deputies and the Speaker of the Duma of the 4th convocation for timely allocation of the Oblast budget funds for the repair works.
Vitaly Ogleznev made a political statement and called on the deputies as active participants of the political life to protect and develop civil society institutions.

ADJUSTED BUDGET
The Oblast deputies adopted in two readings amendments to the Oblast Law“On the Oblast budget for 2012 and the planning period of 2013 and 2014”. The revenues and expenditures were increased by 274,849,500 rubles. This money was allocated to the budget of Tomsk Oblast as financial aid by the Fund for Assistance to Housing and Public Utilities Reform. It will be spent on major repairs of apartment blocks and relocating people from unfit housing.
The revenues of the amended 2012 budget now total 36,650,259,500 rubles, including tax and non-tax revenues of 30,555,015,300 rubles; non-repayable receipts of 6,095,244,200 rubles; and expenditures of 36,650,259,500 rubles.
The amendments were adopted in two readings.
The amended expenditures to support the investment and innovation activity in Tomsk Oblast have totaled 2,499,876,800 rubles, i.e. were increased by 165.4m rubles.

SCHOLARSHIPS FOR YOUNG TEACHERS
The Oblast deputies passed in two readings amendments to the Oblast Law “On provision of interbudgetary transfers”. The amendments are supposed to raise the attractiveness of the schools in Tomsk Oblast for young teachers.
This is a pressing issue, particularly for the rural areas, therefore starting from January 1, 2012 additional financial aid will be provided to young teachers from the Oblast budget by means of an interbudgetary transfer for the Tomsk Oblast Governor’s scholarship.

By the Governor’s decree the allowance will depend on the years of service:

– In educational institutions located in cities:

  • Up to 1 year – 2,000 rubles
  • From 1 to 2 years – 3,000 rubles
  • From 2 to 3 years – 4,000 rubles

– In educational institutions located in rural areas:

  • Up to 1 year – 4,000 rubles
  • From 1 to 2 years – 5,000 rubles
  • From 2 to 3 years – 6,000 rubles

This initiative was included in the general education modernization project of Tomsk Oblast for 2012. The Tomsk Oblast Department of General Education estimates that the headcount of young teachers in the regional and municipal educational institutions of Tomsk Oblast is 365 people, 250 in cities and 115 in rural areas.
The total amount allocated from the Oblast budget for the scholarships to young teachers is 19,608,200 rubles, including 17,499,000 rubles for the implementation of the law.

NEW TAX RATES FOR GAMBLING BUSINESS
The Oblast deputies made amendments to Article 1 of the Law of Tomsk Oblast “On gambling tax rates”.
The amendments bring the Oblast legislation in line with the amended Tax Code of the Russian Federation which became effective on January 1, 2012. One of the changes is the extension of the list of taxable facilities. The extended list includes totalizators and betting offices and their processing centers.
The amendments to the Oblast Law "On gambling tax rates” establish the following maximum rates: 125,000 rubles for one processing center of a totalizator or betting office and 7,000 rubles for one totalizator or betting office.
The rates have not changed significantly since the previous version. However, the adopted amendments will increase the Oblast budget revenues in 2012 provided that totalizators and betting offices register with the tax authorities. Currently, there are 5 such taxable facilities in Tomsk Oblast. There are no registered processing centers in Tomsk Oblast.

ADDITIONAL ALCOHOL SALE RESTRICTION
The deputies adopted in the first reading the bill “On additional alcohol sale restrictions in Tomsk Oblast”. The bill prohibits the retail sale of alcohol from 10 pm until 9 am, except in catering facilities. On days of cultural and entertainment events in the populated localities where the said events are taking place – from 9 am until 6 pm.
Vladimir Kravchenko, Chairman of the Committee for Legislation, State Structure, and Safety, put forward the Committee’s recommendation to pass the bill in the first reading. The Committee also suggested holding a public hearing before considering the bill in the second reading in order to listen once again to all relevant opinions.
The Oblast law-makers have the authority to establish the hours from 10 pm until 9 am when alcohol sale will be prohibited. Such restriction hours are already in force in Novosibirsk, Irkutsk, and Leningrad Oblasts and Primorsky Krai. Some regions established the hours from 9 pm until 11 am. As Vladimir Kravchenko says, the deputies’ task is to come up with a “golden mean”. After a long discussion the bill was passed in the first reading.

BIRD POPULATION CONTROL
The environmental legislation of Tomsk Oblast was brought in line with the federal laws. The deputies backed in the second reading the bill “On amending certain legislative acts of Tomsk Oblast”. The point of the bill is to put on the list of game resources of Tomsk Oblast the hooded crow and the fieldfare. The hooded crow population in Tomsk Oblast is substantial, almost 500,000. According to the experts from the Department of Natural Resources and Environmental Protection of Tomsk Oblast, crows cause serious damage to game birds by destroying clutches and nestlings. It is expected that hooded crows will be killed as part of sport hunting aimed at decreasing their numbers and the impact they have on game birds. The regional environmentalists believe that the number of fieldfares in the hunting areas – almost
1 million – is enough to allow sport and amateur hunting. The fieldfare often carries ticks (tick-borne encephalitis).
Igor Chernyshev, Chairman of the Committee for Labor and Social Policy suggested getting back to the bill in a year and evaluate whether it had been right to put the hooded crow and the fieldfare on the game resources list.

QUALITY CONTROL
The deputies passed amendments to the Oblast Law “On certain measures to ensure food quality and safety in Tomsk Oblast”. According to the report by Ivan Klyain, Chairman of the Economic Policy Committee, the Oblast Law should be brought in line with current legislation in accordance with the prosecutor’s protest. The major change is that Tomsk Oblast no longer controls food quality and safety as this power was delegated to the federal executive bodies.
“However, we decided to keep the voluntary food labeling standard,” Ivan Klyain noted. He assured that food quality control at the regional level is now provided by a federal executive body.

RULES TO PURCHASE LAND
The deputies passed in the first reading amendments to the Law “On rotation of agricultural land in Tomsk Oblast.” It is proposed to take away from the Oblast law provisions on land condemnation and cancellation of title to land as this regulations already exist in the federal law.
At the same time, the regional law could stipulate a procedure for determination of the area of a land plot allocated on the basis of the owned land share taking into account the condition and properties of its soil.
It is important to set at the regional level the price for a land plot belonging to categories such as agricultural land or municipal or federal property on condition that the lessees effectively use this land plot for three years after the conclusion of the lease agreement. Effectiveness criteria are defined by the federal law.
The bill was passed in the first reading.

LAND FOR SUMMER AND PERMANENT HOUSES FOR LARGE FAMILIES
The deputies adopted in the second reading the amendments to the Law “On provision and withdrawal of land plots in Tomsk Oblast” which define the procedure of free-of-charge provision of land plots for countryside summer housing to eligible large families.
According to the bill, a land plot shall be given to families with three and more children free of charge but only once. Families with five and more children are on the priority list.
The deputies passed in two readings amendments to the Oblast Law “On special-purpose housing in Tomsk Oblast”. Currently, housing is provided to large families with five and more underage children who were registered as in need of housing before January 1, 2011. The amendments will spread the Oblast Law over the families who were registered as in need of housing before June 1, 2011.
The originators of the amendments explained that the extension of the time frame was needed for prioritization purposes.
