XLIX Session of the Legislative Duma of Tomsk Oblast

The XLIX Session of the Legislative Duma of Tomsk Oblast was broadcast online. Website duma.tomsk.ru published the annotated agenda of the session and wordings of all documents submitted for consideration by the deputies.

The session was attended by a deputy of the State Duma of the Russian Federation Maksim Korobov and the Representative of the Legislative Duma of Tomsk Oblast in the Russian Federal Assemble Federation Council Vladimir Zhidkikh.

Duma Speaker Boris Maltsev opened the session with his salutary address to the deputies (Full text of the Speaker's speech).

Deputies’ statements
At the beginning of the session a number of deputies made statements.

They talked about the reduction of energy bills and adjustment for the first quarter of 2011, which helped many enterprises come out of loss-making.

A statement was made on keeping the school in Baturino (Tomsk Oblast) which currently teaches 42 children. The Governor responded that that issue was under his personal supervision.

Another statement was made on financing cultural institutions, particularly community clubs.

Kindergarten payment compensation
From July 1, 2011 a new unified procedure of calculating a compensation of part of the kindergarten payment is established. Low-income families will receive an increased compensation payment, but no more than 1,000 rubles on a monthly basis. This amount will be annually adjusted according to the consumer price index. This year, 124m rubles will be spent for that from the Oblast budget.

The law was passed in two readings.

Effective separation
The deputies passed in the first reading amendments to the Law “On organization of motor vehicle transport services for the citizens in Tomsk Oblast.” According to the originators of the bill, transport services for the population can be improved by dividing powers between the Administration of Tomsk Oblast and the authorized transport services authority (Oblast Construction and Architecture Department).

New approach to governing vocational education

The deputies passed in two readings amendments to the Oblast Law “On the system of executive bodies of Tomsk Oblast and the structure of Tomsk Oblast Administration” which modify the structure of vocational education management.

At present, intermediate vocational education is governed by two structural units of Tomsk Oblast Administration – Higher and Intermediate Vocational Education Committee and Elementary Vocational Education Office. The latter owns the budget of intermediate vocational education. From now on, it is the only governing body for intermediate and elementary vocational education.

According to a deputy Nikolay Kirillov, “the Governor should have only one deputy, as we see it, responsible for the education in the Oblast.”

Press conference by the Speaker

Speaker of the Legislative Duma of Tomsk Oblast Boris Maltsev held a traditional press conference during the break.

Answering the journalists’ questions, Boris Maltsev shared his view on the issue of deceived construction shareholders and told about his impressions of the just-ended XIV Tomsk Innovation Forum INNOVUS: “The fact that the forum gathered not just 3,000 participants but 3,000 smartest people means a lot. The forum was more about business than before – hundreds of companies and firms came not only to talk but do business.”

The Speaker answered questions on kindergarten payment compensations and compensation payments to rehabilitated victims of political repressions. He also explained why he would vote for the law that entitles students coming from different cities to elect the Oblast parliament.

New approach to elections
One of the amendments to the Law “On election of deputies to the Legislative Duma of Tomsk Oblast” adopted in the first reading grants Tomsk university students coming from other regions of Russia the right to vote at the Oblast Duma elections.

Another amendment expands the rights of electoral associations.

And the third amendment sets the maximum amount of a candidate’s expenses from their election fund. It is proposed to set a fixed amount instead of an amount multiple of the national minimum wage rate.

At least half of the deputies in the representative body of the municipal area and city district consisting of 20 or more deputies, shall be elected either under the proportional or mixed-member electoral system. When the number of deputies is less than 20, proportional, mixed-member, or majoritarian electoral systems can apply. The number of deputies to be elected in one constituency shall be established by the charter of the municipal entity.

The Law “On road fund of Tomsk Oblast”
The deputies reviewed in the first reading the bill “On road fund of Tomsk Oblast” which establishes a definition of the regional road fund as part of the Oblast budget which shall be used to finance road-building activities such as motor roads engineering, construction, rebuild, repairs, and maintenance.

Rural communities lack good managers

The deputies adopted in the first reading amendments to the Law of Tomsk Oblast “On guaranteed prerequisites for activity of persons in municipal offices and municipal service positions under fixed-term employment contract (agreement)” which establish legislative regulation of a possibility to have assistants for deputies in the representative bodies of municipal areas acting on a temporary basis.

Carriers, not drivers

Amendments to the Law “On requirements to passenger transportation by taxi cars in Tomsk Oblast” were developed in connection with the expert opinion of the Russian Ministry of Justice Office in Tomsk Oblast on the content of the document. The current version of the Law stipulates that both carriers providing taxi cars for passenger and baggage transportation and taxi drivers can be held liable for breach of the administrative law.

However, administrative liability for violating the procedure for organization of taxi car transport services should apply only to carriers (sole proprietors and legal entities) and not employed drivers.

Law on keeping pets refined
In the second reading the deputies passed amendments to Tomsk Oblast Law “On keeping dogs and cats in Tomsk Oblast.”

The new version does not feature provisions on dwelling space norms for the person living with a pet and provisions which do not allow keeping dogs of potentially dangerous breeds to people with mental disorders, alcohol and drug addiction, or adjudged legally incompetent.

Besides, new articles were introduced to the Law which regulate sale of pets and public control over compliance with pet keeping rules.

Based on the comments of Tomsk Oblast Prosecutor’s Office the bill was revised to alter the article on local government powers concerning stray animals and keeping pets; and the articles on pet sale. Articles on pet and stray animal registration and stray animals catching were made more specific. If a stray animal remains unclaimed for over six months, it becomes municipal property and shall be used at the discretion of the local governing body.

Following the adopted amendments the deputies approved respective adjustments to the Administrative Code of Tomsk Oblast. Now the requirement to wear a muzzle does not apply to cubs under three months and small breed dogs (up to a shoulder height of 25 cm). This requirement does not also apply to dogs with short snout when fixing a muzzle is difficult, and dogs carried in a special container.
